According to industry sources, crypto exchanges are not only being investigated by the ED, but also by the Department of Income Tax and the GST Commissioner. The ED is reportedly examining the details of the offshore transactions. (ED Notice)<\/p>\n\n\n\n
The ED had summoned WazirX officials a year ago regarding crypto transactions worth around INR 2,800 Cr, which the agency said violated FEMA rules.<\/p>\n\n\n\n
The matter is pending before the Karnataka High Court, where the company and its director filed a written petition and the court approved an interim order. We have complied with the order. The matter is subjudice. WazirX is not the only exchange that has received such a call.<\/p>\n\n\n\n
GST Commissioner Crack Down On Crypto Exchange<\/h2>\n\n\n\n
The Mumbai Area GST Commissioner detected a GST evasion of INR 40.5 Cr by WazirX, India’s largest crypto exchange by trading volume, in December 2021. He also recovered INR 49.20 Cr in related cash with evaded GST, interest and penalties.<\/p>\n\n\n\n
The company is charging a commission for each cryptocurrency transaction from both the buyer and the seller. However, the commission rate is different for both transactions. The rupee transaction attracts the 0.2% commission and the WRX transaction attracts the 0.1% commission, the Finance Ministry said in a statement at the time. (ED Notice)<\/p>\n\n\n\n
He alleged that WazirX was paying GST only on the commission earned in rupees, not on the commission earned in WRX. Later in March 2022, Minister of State for Finance Pankaj Chaudhary informed Parliament that the government had recovered a total of INR 95.86 Cr from 11 leading cryptocurrency exchanges in the country including CoinDCX, WazirX, CoinSwitch Kuber and Unocoin.<\/p>\n\n\n\n
The Indian government has not yet made its position on cryptocurrencies clear.
